Uniontown,
PA - Jul. 22, 2004 - Penda’s attorneys were
sanctioned for violating the rules of professional conduct.
As a result, STK was awarded attorney fees. In an extraordinary
decision on July 16, 2004, STK won two of its three motions
against Penda Corporation in Federal District Court. STK
prevailed in proving that Penda Corp. instituted frivolous
lawsuit claims against STK. As a result, Penda has been ordered
to pay STK attorney fees which alone is highly unusual, and
even more remarkable is that these sanctions against Penda
were so promptly levied at this stage of litigation. A third
motion is still pending, but because the third motion is
so closely linked to one of the already successful first
two, it is anticipated that STK will prevail on the third
motion as well. Furthermore, attorneys from two prominent
law firms representing Penda were also sanctioned for violating
the Pennsylvania Rules of Professional Conduct.
Speaking
on behalf of STK’s management, Kent Buckingham states:
“Obviously
we are very pleased with the Federal District Court’s
decision in this matter. It has been our firm belief since
day one that Penda has acted inappropriately and in an intimidating
fashion with respect to their frivolous litigation filings.
We believe that Penda’s intentions through these lawsuits
are quite clearly to suppress STK as a competitor. We are pleased
that the United States District Court has ordered Penda to
pay the price for the frivolous litigation that they initiated.
This decision demonstrates that STK will not be intimidated
by Penda, either in the courtroom or in the marketplace. STK
intends to pursue any and all legal options at its disposal
with respect to Penda’s history of behavior.”
